Another Federal Judge Rules Against Trump's Immigration Order

As the Trump administration grapples with the Ninth Circuit's refusal to reinstate the President's travel ban, a federal judge across the country dealt another significant blow to the executive order in Virginia late Monday, writing in her opinion: "Maximum power does not mean absolute power".

"Brinkema also ruled that the order was "disruptive to the operation of [Virginia's] public colleges and universities", resulting in reduced revenue, causing "'anxiety, confusion, and distress" among university personnel, and "inflaming "anti-American sentiment'" overseas.

It's the Seattle court where Judge James L. Robart on February 3 called for a temporary nationwide halt to Trump's travel ban, which the White House appealed to the 9th Circuit. Brinkema ruled that the executive order is in fact a "Muslim ban" as proposed by Trump on the campaign trail, and is therefore in violation of the First Amendment of the constitution. She said the president's own remarks drew her to that conclusion.

While the commonwealth was able to prove harm-to the states universities and public colleges-the federal government failed to justify the order.

The Yemeni men have since been allowed to enter the United States.

President Donald Trump's travel ban has been enjoined in Virginia. Trump has raised the possibility that he will issue a new executive order to replace the one being challenged in court.

"Defendants have not denied any of these statements or produced any evidence, beyond the text of the EO itself, to support their contention that the EO was primarily motivated by national security concerns", Brinkema wrote in her opinion. "Every presidential action must still comply with the limits set by Congress' delegation of power and the constraints of the Constitution, including Bill of Rights", she wrote.

U.S. District Judge James Robart - who issued the temporary restraining order at the request of Washington state and Minnesota on February 4 - rejected the U.S. Justice Department's request to pause the underlying case in lower court while the 9th U.S. Circuit Court of Appeals decides whether a larger, 11-judge panel will review the case.
