Colorado man freed again after prison mistake

As it turns out, Lima-Martin is not a legal USA citizen.

He remained on the ICE hold as of Wednesday evening, and the Denver Post reports that immigration authorities indicated that he could be deported.

A man convicted of a kidnapping and robbery who put his life back together following his release, only to be imprisoned again, won his release on Tuesday, but it didn't last long.

"Technically the way it would work is we're not holding them after their release", he said, adding that they normally notify ICE when they plan to release someone so ICE can be there.

In an emailed statement Wednesday night, ICE said that Lima-Marin was "ordered removed" by a federal immigration judge in Denver years ago - on November 1, 2000. In the ruling, he called Lima-Marin's re-incarceration "utterly unjust". USA officials said in January the repeal of the policy dealt more with cases going forward, and acknowledged Cuba would continue to review case by case when the US government sought deportations.

State Reps. Paul Rosenthal and Dave Williams have written a letter asking Gov. John Hickenlooper to grant a pardon to Rene Lima-Marin as a possible legal remedy for the 38-year-old Aurora man who was ordered released from prison Wednesday only to be taken into custody by immigration officials who could possibly deport him to his native Cuba. He was rearrested in 2014 when authorities discovered their mistake. In a 165-page opinion obtained by the Denver Post, Chief Arapahoe County District Judge Carlos Samour Jr. ordered his release. Lima-Marin was then released on parole in 2008.

"His case was unique in that sense", Diego said. "Not all people who are rehabilitated behave that way".

His wrongful release in 2008 was due to an error in paperwork that said Lima-Miran's sentences were to be served concurrently, instead of consecutively according to CNN. He was mistakenly released.

May 2017 - A judge orders Lima-Marin to be released from prison, saying it would be "draconian" to keep him in prison and that he had paid his debt to society.

Lima-Marin was first incarcerated in April 2000 after being found guilty of multiple counts of kidnapping, burglary, aggravated robbery, and use of a deadly weapon during commission of a crime.

While a gun was used in the break-ins, no shots were fired and no one was injured, according to the judge.

During those six years when he was free, Samour said Lima-Marin did everything he was supposed to, including completing parole without a single violation.

He also called the government's actions, "conscience-shocking deliberate indifference".

Rene Lima-Marin's wife was ready to pick him up from prison.

Diego told the Post that she is searching for an immigration specialist to clarify Lima-Marin's status.

"He is in trouble now because of the result of the normalization process which is opening up the possibility, but legally there is no agreement between the two countries to exchange criminals, so he might be in limbo", Arcos said.

ICE confirmed their detainer, forcing corrections staffers to turn over Lima-Marin over.
