Ads and an injunction: Alberta-BC pipeline war continues


Notley said she felt Horgan had blinked but some say the blink was kind of squinty-eyed.

She announced Alberta will suspend its embargo on B.C. wine imports, which began earlier this month. Alberta is a key market - about 20 per cent of bottled and produced B.C. wine is sold there.

Notley said that task force will stay in place and will meet next week to continue to explore ways to get Alberta oil to tidewater and respond to similar future challenges.

He added, "What we have clearly said is that the federal government holds authority over the [Trans Mountain] pipeline and we will clearly not entertain non-jurisdictional delays meant to stall or stop the project".

They also remind Alberta's neighbours that what goes through pipelines is a federal responsibility - it's not up to their provincial government.

This past Wednesday, the marketing and governance organization made up of the bulk of B.C.'s wineries sent out a media release stating they'd be taking legal action to challenge the constitutionality of the ALGC's ban.

Horgan denied that B-C is backing down in the dispute, saying the intention is simply to have cooler heads prevail. " stepping back from the brink and abiding by the law, and this is a good thing".

"The question (then) becomes 'Do they (B.C. officials) come up with something else, though, to put to the B.C. Court of Appeal, ' and if that's the case what alternatives do we have at our disposal?"

With the ban now lifted, Northern Lights Estate Winery owner Pat Bell says the whole situation was unfortunate.

Prodan said the ban also highlights the importance of free interprovincial trade.

Ralston said B.C. chose the CFTA to dispute Alberta's actions, rather than the NewWest Partnership, a trade agreement of the four Western provinces, because Alberta's boycott raises issues of a national interest "that should be considered by every jurisdiction in the federation".

But the B.C. government will wait for a court ruling before moving ahead on the most contentious measure - a proposed restriction on any increased volumes of diluted bitumen through rail or pipeline, until a special scientific panel could complete a study to fill in knowledge gaps about spill risks and mitigation - a process expected to take a couple of years. "We're trying to make a point and to de-escalate".

"I'm confident that the courts will not give B.C. rights it does not possess under our Constitution", she said.

Both Notley and the Trudeau government expressed confidence the courts will find B.C. can't impinge on federal authority in this area.
