Caputo on Mueller interview

US President Donald Trump's lead lawyer for dealing with Special Counsel Robert Mueller's Russian Federation probe is stepping down at the end of the month, and is being replaced by Emmet Flood, a veteran of Bill Clinton's impeachment fight, the White House said Wednesday.

He is reportedly to be replaced by Emmet Flood, a Republican defense lawyer who represented Clinton during his impeachment proceedings.

President Trump's legal team appears divided over whether to grant an interview with special counsel Robert Mueller or whether to resist. John Dowd, then Trump's lead lawyer, was outraged.

The Post said Mueller had raised the possibility of a subpoena after Trump's lawyers said the president had no obligation to talk with federal investigators involved in the probe.

President Trump just got a peek at nearly 50 questions he'll be asked in an even more serious setting, and all anyone can talk about is who may have leaked them.

Members of the D.C. bar I spoke with believe that Trump's safest bet, if he is subpoenaed, is to take the Fifth.

"If the president wants this investigation to come to an end, it's only going to come to an end when the president testifies to the special prosecutor", he said.

"The appointment was not in compliance with Justice Department regulations for appointing a special counsel because you're supposed to have a basis for a criminal investigation, which they didn't", McCarthy explained.

Trump has incorrectly asserted that the Mueller questions leaked to the New York Times by his lawyers deal only with "false" charges of obstruction of justice.

Although Mueller's team has indicated to Trump's lawyers that he's not considered a target, investigators remain interested in whether the president's actions constitute obstruction of justice and want to interview him about several episodes in office.

The president's precarious position is not limited to questions about obstruction.

This all started many months ago when Trump, a master storyteller, opened up a new front against the investigation.

Despite that, Trump wrongly tweeted on Tuesday that none of the leaked questions deal with any alleged "collusion" between his campaign and Russian Federation. He can demand a face-to-face interview with the president, with Trump's attorneys present.

"This signals a new phase", said one senior Trump adviser who was granted anonymity to describe private conversations. "A rigged system!" On the sidelines, Republicans have been threatening to impeach the Trump administration's own Deputy Attorney General Rod Rosenstein, the man who has green-lighted the Russian Federation probe and had attracted the ire of Trump supporters.

Cohen is tied up in multiple legal battles over alleged "hush money" payments to adult film actress Stormy Daniels, who claims to have had an affair with Trump in 2006.

For a second straight day, Trump protested the Russian Federation investigation amid negotiations by attorneys over whether he will comply with Mueller's request to provide testimony - talks that are shadowed by the prospect of an unprecedented subpoena of a sitting president. Mueller is investigating Russian meddling in the 2016 election, whether Trump's campaign coordinated with Russia in any way and whether Trump obstructed justice after the election.

"They know more about the Trump campaign than anyone who ever worked there", Caputo said. What are they afraid of?

In a Tuesday tweet, Trump blasts what he calls a "rigged system". Why so much redacting? "What the President was thinking is an to the President's unfettered power to fire anyone..." "Why such unequal 'justice?'" in the same tweet.

Although Trump didn't specify how he will "get involved" in the process, he could do so in a variety of ways under the Constitution, including firing Deputy Attorney General Rod Rosenstein and ordering declassification of the documents and turning them over to Congress.

Both in USA v. Nixon (telling Richard Nixon to turn over the tapes pursuant to a subpoena) and in the Paula Jones case (rejecting the argument that participation in a civil matter including a deposition "may impose an unacceptable burden on the President's time and energy, and thereby impair the effective performance of his office") the court held that the president is not beyond the reach of the normal discovery process in either criminal or civil matters.
